This Florida Notice of Homestead is designed for a single individual and is filed after a judgment has been filed but before a levy has been made and when there is a contract to sell, or a commitment from a lender for a mortgage on a homestead. This Notice of Homestead must be filed in the public records of the county in which the homestead is located. It should be noted that a Notice of Homestead can be filed only after the homeowner has applied for and received a homestead property tax exemption, a separate process from the filing of this Notice of Homestead.
It is important to note that homestead exemptions do not apply in Florida against liens and judgments for taxes, obligations for purchase of real property or in other specific situations.
